Terms of service.
1. The service
1.1 Pevnost is an encrypted tunnel (WireGuard) between your device and our servers, through which you reach the internet, plus a DNS resolver available inside the tunnel.
1.2 In our assessment Pevnost is an information‑society service and a “mere conduit” intermediary under Article 4 of Regulation (EU) 2022/2065 and Act No. 480/2004 Coll. We do not select or modify the information transmitted and do not choose its recipients. We have not notified the Czech Telecommunication Office as a provider of an electronic communications service and do not consider ourselves one; your internet access is your own provider's. Should a competent authority decide otherwise, section 7 of the privacy policy applies.
1.3 Contact point for authorities under Art. 11 DSA and for users under Art. 12 DSA: legal@pevnost.net (Czech, English). Abuse reports: abuse@pevnost.net; we respond in writing, block ongoing destinations where needed, and count every report in our transparency report.
2. Account
2.1 The contract is concluded when an account identifier is generated and a subscription paid; during the private beta, when an invite is used. You need not give a name or e‑mail. There is currently no account recovery: if you lose the identifier, the account is lost.
2.2 You are responsible for keeping the account identifier.
2.3 You must be at least 16 years old.
2.4 The contract runs for the prepaid period and ends automatically unless renewed.
3. Price and payment
3.1 The price list is on the website. Payment methods currently offered are listed on the website at the time of purchase (at launch: bank transfer, Bitcoin, Lightning, Monero; cards and cash by post later).
3.2 Subscriptions do not renew automatically unless you explicitly choose so where a payment method allows it.
3.3 Refunds. Within 30 days of your first payment we refund on request, no questions asked: card to the original card, crypto to an address you name, bank transfer to the paying account, cash by bank transfer or crypto to details you give us.
3.3a Consumers in the EU additionally have a statutory right to withdraw within 14 days of payment without giving reasons, by e‑mail to support@pevnost.net or using the model form in section 10. By asking us to activate the service immediately you expressly agree that we start before the withdrawal period ends and acknowledge that the right lapses once the paid period has been fully provided; if you withdraw earlier, we refund the unused part pro rata, by the same means you paid with unless you agree otherwise.
3.4 Prices on the website are final for consumers. We are not currently registered for VAT. Where VAT is due, the amount shown before you confirm payment includes it.
4. Rules of use
4.1 You may not use the service for attacks on third‑party systems (denial of service, unauthorised scanning or exploitation), unsolicited messaging, distribution of malware, material depicting sexual abuse of children, conduct that is a criminal offence under Czech law, or harassment.
4.2 Outbound traffic on TCP port 25 is blocked. No other ports are filtered.
4.3 Breach may lead to termination; the unused part of the subscription is not refunded where the breach is serious. Because we keep no records of activity, we can usually detect a breach only through an external complaint about conduct that is ongoing at the time. Complaints and notices are handled as described in 1.3.
4.4 Fair use: one account for up to 5 devices at a time. There is no data cap, but we may limit the speed of an account that persistently and significantly loads a server to the detriment of others.
5. Availability, support, liability
5.1 We aim for 99.5 % monthly availability without a contractual guarantee. Planned maintenance is announced on the website.
5.2 Support is by e‑mail at support@pevnost.net, usually within one working day, and covers the operation of the service and connection setup, not third‑party devices and apps beyond our published guides.
5.3 To the extent permitted by law, we are not liable for content you access or for acts of third parties. For unavailability our liability is limited to a pro‑rata refund; nothing in these terms limits rights that consumer law grants you.
5.4 We do not promise anonymity against lawful interception on our suppliers' networks, and we are not responsible for disclosure of your identity by your own conduct (logging into personal accounts, for example).
6. Data
Processing of personal data is governed by the privacy policy, which forms part of these terms.
7. Termination
7.1 You may delete your account at any time; unused subscription time is not refunded except under 3.3 and 3.3a.
7.2 We may terminate with one month's notice, or immediately upon breach of section 4. If we terminate without breach, the unused part of the subscription is refunded.
8. Changes
Changes are announced on the website 30 days in advance, with the version number and effective date shown at the top of this page. If you disagree, you may terminate and receive a pro‑rata refund. Previous versions are available on request.
9. Governing law
Czech law applies. Consumers may bring out‑of‑court disputes to the Czech Trade Inspection Authority (Česká obchodní inspekce, Štěpánská 567/15, 120 00 Praha 2, www.coi.cz, ADR section). Court jurisdiction for non‑consumers: courts of the Czech Republic.
10. Model withdrawal form
Fill in and send only if you wish to withdraw from the contract as a consumer (3.3a).
